Exclusivity in Brand Deals: What It Means and How Much to Charge

How to price an influencer exclusivity fee by scope and length, test it against deals you’d lose, plus clause wording and what to do if a brand assumes it.

An exclusivity clause is a promise not to promote certain other brands for a set time. It restricts you rather than your content, and it only applies if you agree to it. Every clause should answer four questions: who counts as a competitor (a named list, one product type, a whole category or an entire industry), what content is off-limits, which platforms it covers, and when it starts and ends. Scope moves the price more than length, and a window that runs from signing until long after your last post can restrict you for far longer than the headline number.

Usage rights, exclusive licenses and exclusivity are three different things. Usage rights control what a brand can do with your content. An exclusive license controls who else may use that piece of content. Exclusivity controls which other brands you can work with. A long ad license does not make you exclusive unless the agreement says so, though brands often ask for exclusivity to match their paid-ad window. Price each as its own line. Platform defaults differ: Backstage gives brands an exclusive license on UGC by default, while #paid grants a non-exclusive one-year license.

Published sources rarely put a number on exclusivity. Later's 2026 pricing guide says it adds a premium that grows with length and breadth. Influencer Marketing Hub's 2026 rates guide prices one example at 30 percent of the base fee for 60 days of category exclusivity, and JoinBrands' 2026 UGC guide puts three to six months away from direct competitors at 30 to 50 percent, with full vertical exclusivity at 100 percent or more. The guide turns these anchors into a working scale by scope and length, clearly labelled as a negotiating starting point.

Percentages assume your other deals are about the size of this one, so the guide adds an opportunity-cost check: the competing deals you would have taken per month, times the months of exclusivity, times your typical fee for those deals. Quote whichever is higher, the scale price or the opportunity cost. If you rarely work in the category, the scale price is fair. If you work in it often, either charge the full opportunity cost or narrow the scope, for example from all skincare to other vitamin C serums, until the two numbers meet.

A fair clause names the brands or product type, limits the restriction to sponsored content, lists platforms, states start and end dates, sets a separate fee and when it is paid, excludes deals signed earlier and posts already live, prices any extension, ends early if the brand cancels or misses a payment, and says no other exclusivity applies. Red flags include no end date, undefined competitors, windows tied to the brand's last use of your content, exclusivity on gifted deals and penalties bigger than the fee.

If a brand acts as if you agreed to exclusivity you never signed, check the contract, brief, emails and any platform terms. A brand can generally hold you only to terms you agreed to, though it can still choose not to rebook you, so reply once with the facts and write 'Exclusivity: none' on every quote. On Aurelia, exclusivity is never assumed: it's shown on the campaign next to your take-home pay before you apply, written into the agreement generated from the campaign (directly competing brands, sponsored content only, for 30, 60 or 90 days after your last delivery), and binding only when you accept it. This is general information, not legal advice.
