Should Content Creators Get an LLC? Costs, Taxes and When It's Worth It

LLC for content creators, explained: what it protects, 2026 fees in 7 states, why your federal tax stays the same, and when an S corp election pays off.

An LLC for content creators does one job by default: it separates the business from the person. A limited liability company is created under state law, its debts and obligations belong to the company rather than to you as its owner, and it becomes the party that signs brand contracts. It does not lower federal tax. The IRS treats a single-member LLC as an entity disregarded as separate from its owner, so creator income still goes on Schedule C and the owner still pays 15.3% self-employment tax on 92.35% of net earnings, exactly like a sole proprietor.

Whether an influencer should get an LLC depends on signals, not on an income line set by law. It tends to be time when you sign brand contracts most months, pay an editor or other contractors, have savings or a home to keep apart from the business, or do work beyond posting such as events and giveaways, and when your state’s yearly cost is small next to your profit. It can wait when income is a few hundred dollars a month, when the state charge would take a real share of profit, or when the only goal is saving tax.

State costs vary widely. As of October 2026, California charges $70 to file articles of organization, $20 for a statement of information and an $800 annual tax. Texas charges $300 to form, with no franchise tax at or below a $2.65 million threshold. New York charges $200 plus a $50 certificate of publication and requires newspaper notices within 120 days. Florida charges $125 and $138.75 a year, Delaware $110 and $400 a year, Wyoming $100 and at least $60 a year, and Colorado $50 and $25 a year. An EIN from the IRS is free, and forming in your home state is usually simplest.

Tax savings come only from electing S corporation status with IRS Form 2553. The LLC then pays its owner a salary that carries 15.3% in Social Security and Medicare tax, and profit above that salary passes through as a distribution. The IRS requires reasonable compensation before distributions. In an illustrative example with a $50,000 salary, the difference is $828 a year at $60,000 of profit and $13,544 at $150,000, before the added cost of payroll returns, a separate Form 1120-S and a smaller qualified business income deduction. This is general information, not tax advice.

The paperwork changes less than most people expect. On Form W-9, a single-member LLC with default tax treatment still lists the owner’s name on line 1, the LLC on line 2, and the owner’s SSN or the owner’s own EIN, not the LLC’s EIN. A sole proprietor who has an EIN can use it on a W-9 too, so keeping a Social Security number off brand paperwork does not require an LLC. What should change is who signs contracts, the name on invoices and the bank account that receives the money. US-formed companies no longer file beneficial ownership reports with FinCEN under a final rule effective August 14, 2026.

On Aurelia, brands post campaigns and creators apply in a few taps, with no follower minimum and no business entity needed to start. Every campaign shows the creator’s take-home pay, the product, the usage rights and the deadline before they apply, with Aurelia’s fee already taken out. The agreement is written from the campaign and signed in one step. The brand’s budget is paid in before a paid campaign goes live and held until the work is approved, and creators are paid to their bank automatically when the brand approves their work. Bank details go straight to Stripe.
